1. Introduction

By accessing and using this website and/or purchasing an MgoPass membership, you (“you”, “your”, “user” or “member”) agree to be legally bound by these Terms and Conditions. “We”, “us”, or “MgoPass” refers to MgoPass Inc., its directors, employees, agents, partners, and affiliates.

2. Description of MgoPass Service

MgoPass is Morocco's first entertainment membership platform that allows users to access a variety of venues such as zoos, water parks, museums, trampoline parks, and sports events for a flat yearly fee. The service becomes active immediately upon account creation and payment.

3. Membership Requirements

• Users must be 18 years or older to register.
• Parents or guardians may purchase and manage accounts for minor children but assume full responsibility for their use.
• Membership types include Kids, Adults, and Tourist, each available as Basic or Premium.

4. Membership Terms

• Your MgoPass remains valid for 12 months from the date of purchase.
• MgoPass reserves the right to suspend or terminate accounts violating these Terms.
• Each venue may have its own rules, restrictions, and availability (e.g., time slots, peak hours).

5. Venue Partners and Changes

The list of participating venues is subject to change without notice. New venues may be added at no additional cost to active members. Certain venues may offer limited seasonal access or require advance booking.

6. Non-Transferability

Memberships are non-transferable. Each pass is tied to a unique user account and QR code. Sharing or misuse of your membership may result in suspension or termination.

7. Disclaimers

MgoPass makes no guarantees about the availability, quality, or safety of third-party venues. Users visit venues at their own risk. We are not liable for any venue closures, cancellations, or service changes.

8. Limitation of Liability

MgoPass shall not be held liable for injuries, losses, or damages occurring at partner venues; unavailability or discontinuation of partner services; or any indirect, incidental, or consequential damages arising from service use.

9. Indemnification

You agree to indemnify and hold harmless MgoPass from any claims, damages, or expenses arising from your misuse of the service or violation of these Terms.

10. Data Privacy

We protect your data in accordance with our Privacy Policy.

11. Intellectual Property

All content on this website and in the MgoPass app, including logos, graphics, and text, is the exclusive property of MgoPass Inc. Unauthorized use is prohibited.

12. Communications

By signing up, you consent to receive service-related communications via email, SMS, or push notifications. You may opt out of promotional communications at any time.

13. Modifications

MgoPass may modify these Terms at any time. Continued use of the service after changes constitutes your acceptance.

14. Governing Law

These Terms are governed by Moroccan law. Any disputes shall be resolved by competent courts in Casablanca, Morocco.

15. Prohibited Conduct

Users may not misuse the MgoPass platform, engage in fraudulent activity (e.g., selling or sharing passes), or violate any applicable law.

16. Refund Policy

Full refunds are available within 30 days of purchase if the pass has not been used. After usage or expiration of 30 days, no refunds will be provided.

17. Force Majeure

MgoPass is not responsible for delays or service interruptions caused by events beyond our control, such as natural disasters or government actions.
